“…Privacy is not the real issue but control/ownership of data which should lay with the individual and be used/sold based first, on their interests and not those of the data collectors and processors. The key to improved privacy and enforcement is to let the original owner of their data make the determination of its disposition. A federal law should provide a new balance between consumer data privacy and the continued promotion of trade and commerce. To be clear, this proposed law is not meant to be anti-capitalism, nor does it propose making litigation a centerpiece. It reflects new and different incentives for consumers and business given today’s and future realities.
Curiously, the U.S. Constitution does not contain a specific sentence declaring an individual’s right to privacy. Rather, the legal system protects it through various interpretations and statutes. This is an opportunity to anchor privacy more directly to the American legal and economic tradition of private property and ownership.”
